It is, and since everyone will derive that morally from different experiences being for or against the dealth penalty seems just to be a matter of personal opinion

I suppose my real question here is why is that morally vacuousness? We accept the state doing at lot of things that we don't allow individuals to do - extortion (taxation), imprisionment, kidnapping (arrest).

That's a valid worry but it is rather more a question of implementation than theory. For example, if a school shooter was on a rampage, someone shot him, brought him down, and didn't kill him, we can safely try him and execute him with a safe knowledge that he did it.
The idea that there is always uncertainty in cases is wrong. Applying the death penalty very cautiously is fair enough, but we can't use this argument not to apply it at all.

That's true for all punishments. It needs to be delt with regardless of the death penalty.
